Agreement between you and BusCardUp

Welcome to BusCardUp. These Terms of Service ("Terms") govern your access to and use of the BusCardUp website, mobile application, and transit card services (collectively, the "Service"). Please read these Terms carefully before using our Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Service Description

BusCardUp provides transit card management services, including card registration, balance checking, card reloading, and trip planning for public transportation in the United Arab Emirates. Our Service allows users to manage their transit cards and enhance their public transportation experience.

2. Account Registration

To access certain features of the Service, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify BusCardUp of any unauthorized use of your account or any other breach of security. BusCardUp will not be liable for any loss or damage arising from your failure to comply with this section.

3. Card Registration and Use

When you register a transit card with our Service:

  1. You confirm that you are the legitimate holder of the card or have permission from the legitimate holder to register and manage the card.
  2. You agree to provide accurate information about the card and its owner.
  3. You understand that the card is subject to the terms and conditions set by the issuing transit authority.

4. Payment and Reload Services

Our Service allows you to reload your transit card using various payment methods. By using our reload services:

  1. You authorize BusCardUp to charge the payment method you provide for the reload amount plus any applicable fees.
  2. You agree to provide accurate and complete payment information.
  3. You understand that reload transactions may take time to process and be reflected on your card.
  4. You acknowledge that reload transactions are subject to verification and may be declined for various reasons.

Refunds for reload transactions are subject to our Refund Policy and the policies of the transit authority.

5. User Conduct

When using our Service, you agree not to:

  • Use the Service in any way that violates any applicable law or regulation.
  • Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  • Use the Service for any purpose that is fraudulent, harmful, or unlawful.
  • Upload or transmit viruses, malware, or other types of malicious software.
  • Collect or track the personal information of others.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Attempt to access any accounts, data, or information not belonging to you.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BusCardUp and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Arab Emirates and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BusCardUp.

7. Third-Party Links and Services

Our Service may contain links to third-party websites or services that are not owned or controlled by BusCardUp. BusCardUp has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that BusCardUp shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BusCardUp, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

To the maximum extent permitted by applicable law, BusCardUp assumes no liability or responsibility for any:

  • Errors, mistakes, or inaccuracies of content.
  • Personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Service.
  • Unauthorized access to or use of our secure servers and/or any personal information stored therein.
  • Interruption or cessation of transmission to or from the Service.
  • Bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service.
  • Errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available through the Service.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
